1. Introduction
These Contest Rules apply to all Spartan Race contestants. Spartan Race may amend these Contest Rules from time to time.
Entry and participation in any competition shall be deemed an unconditional acceptance by you of these Contest Rules and thus said rules shall be binding on you. All entry instructions and any other specific details relating to the competition or the prizes form part of these Contest Rules.
2. Eligibility
To be eligible for the cash prize, you must be an official registrant for the cash prize heat at the Event. You must be a resident of the United States and a top ten percent (10%) finisher of a 2011 Spartan event at the time you are emailed by Spartan notifying you that you have qualified.
Employees of Spartan Race, its parent and affiliated companies and their immediate families, as well as any press, agencies, sponsors and/or commercial partners or any other persons directly or indirectly connected with the competition and/or business of Spartan Race are not eligible to enter.
You must be at least 18 years old, and if requested to do so, provide proof of your age. If you are under 18 years of age your parent/guardian must sign a minor release for you to participate in the event.
You must provide personal details as reasonably requested to do so by Spartan Race. Refusal to comply will result in disqualification from the contest. All personal details shall be kept confidential.
All entries must be received by Spartan Race by 11pm on October 31, 2011. Any entries received after this time shall be null and void. Entries will be entered automatically upon submission. No responsibility will be taken by Spartan Race for any entries that are illegible, misdirected, lost for technical or other reasons or received after the deadline.
The closing date of the competition may be extended by Spartan Race if an unsatisfactory amount of entries are received.
3. Health and Safety
You confirm, warrant, and represent that to the best of your knowledge your general state of health is good and you have no medical condition that might be adversely affected by strenuous exercise or by any of the events or activities planned or reasonably expected to be involved in the Event.
You agree to co-operate and comply with all reasonable requests of Spartan Race and its agents and employees (in particular with respect to health and safety) in connection with the Event.
You must take all reasonable steps to ensure your own health and safety. Any conduct or behavior, act or conduct by you that Spartan Race considers in its sole opinion, to pose any medical, security or safety risk to you or to others, will lead to your immediate disqualification (including without limitation, any abusive behavior, including physical and/or verbal).
All activities are undertaken at your own risk. You must notify Spartan Race of any medical or other condition which may mean that you are unfit for travel or participation in the Contest as soon as you become aware of such a condition. Spartan Race reserves the right to forfeit your place in the Contest or the prize (without liability or compensation) if, in its opinion, you may expose yourself or others to risk of illness or injury, or to the cancellation, disruption or curtailment of the Contest and/or Event.
You confirm you are not taking any controlled substances or illegal medications (excluding those prescribed to you by your physician) and will not do so during the Contest or the Event. The use of these substances is cause for immediate forfeiture of any prize and removal from the Contest and/or Event.
4. Prizes
All prizes must be collected within three months from the date of winning. After that time, unclaimed prizes will be deemed null and void. Spartan Race will not notify winners of the time remaining. It is the sole responsibility of winners to collect their prize.
A prize in the amount of $10,000 will be given to each the first place male finisher and the first place female finisher of the Contest via company check. Winners are responsible for paying any required taxes on their winnings. Spartan Race shall not be responsible for withholding any taxes.
If a winner chooses not to accept a prize, said winner forfeits any and all claims to that prize, which will be dealt with at the absolute discretion of Spartan Race.
Prizes are not transferable.
Spartan Race, its agencies, affiliates, sponsors and representatives are not responsible for any claims, liability, loss or damages arising out of or in connection with any contest promoted by Spartan Race.
If the winner(s) of the prize cannot be traced after all reasonable efforts having been made by Spartan Race, then Spartan Race may dispose of the prize as it thinks fit without any liability to the winner(s) for having done so.
Entry costs (where applicable) are as advertised. Entrants are liable for their costs to access telephone, mobile or computer networks.
Spartan Race reserves the absolute right to disqualify any entrant to the Contest and/or Event which entrant it considers to have used improper technical means to enter.
5. The Contest
Spartan Race does not accept responsibility for entries lost, damaged or delayed in transit to the competition address. Proof of posting will not be accepted as proof of receipt (nor will proof that an email has been sent be accepted as proof it has been received).
Fraudulent, illegible or incorrect entries will not be accepted (at the absolute and sole discretion of Spartan Race).
Spartan Race may disqualify ANY entrant that it feels in is sole and reasonable discretion has cheated on any part of the Event/Contest or not completed all elements of the course. Spartan Race's decision is final and binding.
The decision of Spartan Race's judges is final and conclusive in all circumstances and no correspondence will be entered into.
Spartan Race may terminate the contest at any time at its absolute discretion. In the event of such termination, Spartan Race may, at its absolute discretion, elect not to award any prize in respect of the terminated Contest.
6. Confidentiality
You undertake not to disclose, reveal, communicate or otherwise make public to anyone at any time any information you may obtain relating to Spartan Race, its business, personnel, servants, agents or officers.
You may not publicize your involvement in the competition, or the fact that you have won a prize if you are one of the winners, without the prior written permission of Spartan Race.
7. Publicity
Competitors/entrants may be required by Spartan Race to participate in a photo, video and/or film session, and acknowledge that Spartan Race has the right to use such publicity photos, videos and/or films in any media and in any reasonable manner it sees fit, with no compensation due to the entrant, unless that person informs Spartan Race at the time of entering the competition that he or she wishes to retain his or her anonymity.
Contest entries and material submitted in connection with the Contest (whether in written, audio, electronic or visual form, or any combination of those) or any photographs, video and/or film footage and/or audio recording taken of competitors become the property of Spartan Race, which may use the material in any media and in any reasonable manner it sees fit, in perpetuity, for no additional compensation to the entrant. Copyright in any such material remains the sole property of Spartan Race.
Spartan Race may publicize, broadcast or otherwise disclose a competitor's name, character, likeness, statements or any recording of his or her voice in advertising or promotional activities concerning Spartan Race contests generally. Spartan Race may promote or advertise that the winner has won a contest.
Spartan Race may incorporate information from entrants in any contest in any database to be used for the purpose of its business. Upon entry into a competition a contestant will automatically give permission for use of personal data and said information will be retained in accordance with the Data Protection Act.
8. Spartan Race - Exclusion of Liability
Spartan Race is not liable in any way for any costs, expenses, damages, liability or injury arising out of or in any way connected with the competition or prizes, other than those costs and expenses specifically provided for in the prize (if any).
Spartan Race shall have no liability with respect top competitions operated by Spartan Race or on behalf of third parties (for example, sponsors) except with respect to death or personal injury directly attributable to Spartan Race's gross negligence or willful misconduct.
Spartan Race accepts no liability (and excludes all liability) for any loss of profit, business, contracts, revenues or anticipated savings or for any special, direct, indirect or consequential loss of any nature howsoever arising.
Spartan Race shall not be liable to perform any of its obligations under the competition or in respect of the prizes where it is unable to do so as a result of circumstances beyond its control (i.e., force majeure) and shall not be liable to compensate any entrant under such circumstances.
9. Jurisdiction
Void where prohibited by law. A failure by Spartan Race to enforce any of these contest rules in any instance(s) will not give rise to any claim by any individual.
Spartan Race may change these Contest Rules Terms at any time.
